Arrest Warrant Versus Bench Warrant Definition
An arrest warrant is issued when a person is accused of having broken a law and it allows the police to arrest the suspected offender. An arrest warrant requires a signed and sworn affidavit showing probable cause.
A bench warrant also authorizes a police officer or sheriff to make an arrest but it may or may not relate to a criminal charge. It can result from a violation of a court order. A bench warrant is issued by a judge for actions like:
- Failing to appear in court/failure to respond to a court summons
- Excessive traffic violations
- Contempt of court
- Failure to report for jury duty
